Terms of use for organizers
1. Scope
These terms govern the use of the platform Eventplanner (“platform”) operated by Benedikt Ulrich, Hornschuchpromenade 29, 90762 Fürth, Germany (“we”) by organizations and persons who publish events and manage registrations (“organizers”). Attendees who register for an event do not need an account; their contract is concluded exclusively with the organizer.
2. Account
- Signing up requires a valid email address and acceptance of these terms and of the data processing agreement.
- Organizers keep their access data secret and are responsible for all actions performed with their account, including those of admins they add.
- There is no right to be admitted. We may refuse sign-ups for objective reasons.
3. Services
The platform lets organizers publish events, collect registrations, send confirmation emails and invitations and connect their own payment accounts (Stripe, PayPal) or display their own payment details. Payments are made directly between attendees and the organizer; we never receive or hold attendees’ money. We aim for high availability but do not guarantee uninterrupted operation; maintenance may cause short interruptions.
4. Fees
Use of the platform is currently free of charge. Organizers may make voluntary payments in an amount agreed individually; voluntary payments do not create any entitlement to additional services or a higher service level unless expressly agreed in text form. Should we introduce fees, we will notify organizers at least 15 days in advance (see section 11); continued free use is not affected without such notice.
5. Responsibilities of organizers
Organizers are solely responsible for their events and content and in particular ensure that
- their legal notice (imprint) and contact details in the settings are complete and correct, as far as required by law;
- event descriptions, prices (including VAT where applicable) and conditions are correct and comply with consumer protection law, including any cancellation and refund terms they offer;
- they have a legal basis for all personal data they enter or import, in particular consent of contacts they invite by email (§ 7 UWG, Art. 6 GDPR) – the platform only sends invitations to people who allowed them or did not object;
- they hold all rights to uploaded texts, images and videos and that no content is illegal, infringes third-party rights, is discriminatory, misleading or harmful to minors;
- they comply with tax, trade and event law obligations, including the issue of invoices.
Organizers indemnify us against third-party claims resulting from culpable violations of these obligations, including reasonable legal costs.
6. Content moderation
- Anyone can report content they consider illegal via the reporting form. We review reports diligently, objectively and without undue delay.
- If content is illegal or violates these terms, we may remove or disable it, unpublish events or suspend accounts. Measures are proportionate; we take into account the severity, frequency and intent of the violation.
- We inform affected organizers of any restriction with a statement of reasons (Art. 17 DSA), unless prohibited by law. Organizers can contest decisions by email to be@nedikt.be; we review such complaints in a timely, non-discriminatory manner.
- We do not use automated tools to moderate content.
7. Ranking
Event lists are ordered by date and by the order chosen by the organizer. Events of different organizers are not ranked against each other, and there is no paid placement.
8. Data protection
For attendee data, the organizer is the controller and we act as processor according to the data processing agreement, which forms part of these terms. Our own processing is described in the privacy policy.
9. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and within the scope of any guarantee given.
- For slight negligence we are only liable for breach of essential contractual obligations (obligations whose fulfilment makes proper performance possible at all and on which the organizer may regularly rely), limited to the foreseeable damage typical for this type of contract.
- Otherwise, liability is excluded. These limitations also apply to our vicarious agents.
10. Term and termination
- The contract runs for an indefinite period. Organizers can terminate at any time by deleting their organization in the settings; this deletes all their data. A data export is available in the settings before deletion.
- We can terminate with 30 days’ notice by email, stating reasons. The right to terminate for good cause remains unaffected.
11. Changes
We may change these terms for objective reasons (e.g. changes in law or new features). We will notify organizers by email or in the admin area at least 15 days before changes take effect. Organizers who do not agree may terminate before the changes take effect.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country of residence remain unaffected. If the organizer is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the place of jurisdiction is Fürth, Germany.
